NC decries PHSC decision

Kathmandu – The main opposition party, the Nepali Congress, has announced it would reject the decision made by the Parliamentary Hearing Special Committee last Friday. Speaking at the start of the House of Representatives’ meeting today, Nepali Congress lawmaker Gyanendra Bahadur Karki charged that the Committee had decided to announce the justice proposed for appointment to the post of Chief Justice disqualified without any ground. “If Deepak Raj Joshi, who was proposed for the Chief Justice post, is unqualified for the post, then what about the status of the Prime Minister who recommended his name,” lawmaker Karki asked, referring to the Constitutional Council chaired by the Prime Minister that recommends names for appointment to the constitutional bodies and the Chief Justice. “The decision taken by the committee on the basis of prejudice and partiality, and without any basis and evidence, is wrong. We declare it illegal and we don’t approve of it,” he added. The NC lawmaker also stated that the PHSC’s latest decision shows that it does not respect the independence of the judiciary, which would pose a challenge to constitution’s implementation itself. Denying the NC lawmaker’s accusation, ruling party lawmaker Birodh Khatiwada charged that the role of the opposition party was oriented towards anarchic tendency. “Can the decision made by two-thirds be overruled by one-thirds opinion in a democracy? If they (the opposition party) tried to do that,...

Democracy, judiciary undermined, says NC

The main opposition Nepali Congress today said the Parliamentary Hearing Committee’s rejection of chief justice nominee Deepak Raj Joshee had undermined democracy and independence of the judiciary. The NC’s party office bearers’ meeting and the meeting of the parliamentary party today reached this conclusion. Both meetings concluded that the Constitutional Council led by Prime Minister KP Sharma Oli had nominated Deepak Raj Joshee for the post of chief justice, but his party’s lawmakers at the PHC had rejected the PM’s recommendation, which was not right. NC’s Joint-general secretary Prakash Sharan Mahat said Nepal Communist Party (NCP) lawmakers were trying to create confusion. “Their PM recommends a person for the post; but some of the party’s lawmakers reject him. “Congress is not talking about one person. We are talking about the process and the institution,” he added. CJ nominee Joshee was rejected by the PHC with two-thirds majority yesterday. NC lawmakers defied the process by boycotting the vote. The NC will question the CJ’s nomination process by  the Constitutional Council in the Parliament, said NC lawmaker Rajan KC. “If Joshee was not deemed fit, why did the Constitutional Council nominate him for the CJ’s post?” he asked, adding that this was an issue that raised the question of the PM’s morality too. He said the opposition party’s lawmakers would raise questions tomorrow at the House of Representatives meeting. Lawmaker Prakash Rasaili...
